UNEMPLOYMENT APPEALS COMMISSION
OVERVIEW
How and when to file an appeal: If you disagree with the hearing officer’s decision, you may file a written appeal with the Unemployment Appeals Commission (UAC). The appeal should be faxed or mailed to the UAC within 20 calendar days of the date the decision was certified as being mailed. If the twentieth day falls on a Saturday, Sunday, or holiday, the appeal may be filed on the next business day. Holidays are defined in Section 110.117, Florida Statutes. The time period to appeal cannot be extended by any other document you receive. The UAC address and fax number are listed below.
- If mailed, the U.S. Postal Service postmark will be the date of filing.
- If faxed, the date the fax is date-stamped received by the UAC will be the date of filing. If you fax your appeal, you are responsible for any delay, disruption, or interruption of the fax signal and accept the full risk that the appeal may not be properly filed as a result. The fax confirmation from your machine does not establish that a legible copy of your fax was actually received by the UAC.
If you do not file an appeal with the UAC, your case cannot be reviewed, and the decision will become final.

What you should include with your appeal:
Your appeal should include the docket number, claimant’s name and social security number, the name of any involved employer, and a brief reason for the appeal. Note: The UAC does not have the ability to translate your appeal; therefore, it should be presented in English. All information should be typed or written neatly. The UAC receives many appeals and needs this information to process your appeal as quickly as possible.
UAC Appeals cannot yet be filed over the Internet; however, you may click here for an appeal form that may be mailed or faxed. Print and complete Section II of the Appeal form to appeal to the UAC. Use of this form is not required, as long as all required information is included in the appeal. If using the form, fill in the requested information completely and neatly and submit by mail or fax as indicated above.
Late appeals:
Appeals filed after the 20-calendar-day time limit expires are generally dismissed as untimely. If filing after the deadline, explain why you did not file within the time limit and why you believe your appeal should not be dismissed as untimely filed.
If you did not participate in the last hearing:
If you are filing an appeal with the UAC, did not participate in the last hearing, and have not directly requested re-hearing through the Office of Appeals, explain why you did not participate in the hearing, and describe any effort you made to have the hearing rescheduled. UAC review:
The UAC will review the record of the hearing. Based on this review, the UAC may affirm, reverse, or modify the hearing officer’s decision. If a significant error or deficiency occurred, the UAC may remand the case to the Office of Appeals for further action. The UAC will not hold a hearing or consider evidence being presented for the first time which could have been brought to the attention of the hearing officer by an exercise of due diligence. Additionally, the UAC will not reweigh the evidence or substitute its factual findings for those of the referee, nor overturn a decision supported by competent substantial evidence which complies with the law.
