FAQ # 7: What do I do after the U.S. Department of Labor certifies my H-2A Program application for work in Florida?
The U.S. Department of Labor (USDOL), Employment and Training Administration National Processing Center Certifying Officer in Atlanta, Georgia will sign and date the ETA 750 Part A “Application for Alien Employment Certification” form. A “Final Acceptance Letter” will be used to return the ETA 750 Part A to you.
It is extremely important that you protect the ETA 750 Part A that has been signed by the Certifying Officer. The certified ETA 750 Part A must be sent to the U. S. Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS) Regional Service Center for Florida, located in Mesquite, Texas. [Texas Service Center] The USDOL National Processing Center will not provide a replacement copy if the original is lost, destroyed or damaged. A copy of the original certified form will not be accepted by the USCIS Service Center.
The USCIS application will include an I-129 Petition for a Nonimmigrant Worker [ Form I-129, Petition for a Nonimmigrant Worker ] and the ETA 750 Part A signed by the Certifying Officer. The complete I-129 application (including the ETA-750) for a Florida job location must be sent to the USCIS Regional Service Center in Mesquite, Texas.
The USCIS website [ USCIS Home Page ] has complete information on filing your H-2A application at the Regional Service Center. Florida based employers who file an H-2A application in another state should contact USCIS or visit the website to determine the Service Center for that state.
HINT: Obtain the I-129 Form the day you mail your H-2A Program application to the U.S. DOL Regional Office and the Agency for Workforce Innovation. The I-129 requires a great amount of information and you can begin filling it out while the USDOL Regional Office and Agency for Workforce Innovation are processing your application. An important goal is to have the I-129 drafted and ready to complete and mail when the certified ETA-750 arrives at your business.
HINT: The USCIS Regional Center has frequent backlogs of applications for the H-2A Program and other Alien Labor Certification Programs. Early submission of the I-129 and ETA-750 will help you avoid undue delays in processing and approving the visas for the H-2A foreign workers.
